Nestle wins ‘KitKat’ trademark lawsuit against Cadbury

Jan 5, 2013: Nestle which has been fighting a pitched lawsuit battle against Cadbury for its KitKat chocolate bar has won it. Nestle had infact taken a trademark for its KitKat Chocolate bar’s four-fingered and three-dimensional shape in 2006 and Cadbury had filed a lawsuit claiming that a general feature like product’s shape cannot be trademarked. Cadbury has been selling KitKat like products such as Crispello in the market and this verdict is seen to affect the way Cadbury is going to sell four fingered and three dimensional shape products. This judgement is also said to be a landmark judgement by experts as this will open up lawsuits for product shapes for which trademark has been taken by companies.
