Employees get the option to select NPS or OPS as benefits on death during service:7th Pay Commission

7th Pay Commission News: Central government employees covered by the National Pension System now have the choice of receiving benefits from the previous pension plan or the accrued pension corpus under NPS if they die while on the job, according to rule 10 of the CCS (Implementation of NPS) Rules, 2021. This option, however, is unavailable to the relatives of the dead government employee.

If a Central Government Employee fails to provide his preference, a benefit under the previous pension system is available as a default choice for the first 15 years of service. The advantages under NPS would thereafter be the default choice.

Under these guidelines, the default option of the previous pension system is in effect until March 2024, even if a government employee has completed 15 years of service.

The CCS (Implementation of NPS) Rules, 2021 were published in the Gazette on March 30, 2021.

Rule 10 of the CCS (Implementation of NPS) Rules, 2021

“Every Government servant covered under the National Pension System shall, at the time of joining Government service, exercise an option in Form 1 for availing benefits under the National Pension System or under the Central Civil Service (Pension) Rules, 1972 or the Central Civil Service (Extraordinary Pension) Rules, 1939 in the event o,” says Rule 10 of the CCS (Implementation of NPS) Rules, 2021.

Government employees who are currently in government employment and are protected by the National Pension System must exercise this choice as soon as feasible, according to this rule Form 2.

The Directorate General of Health Services (DGHS) stated in an Office Memorandum (O.M.) dated 9th June 2021 that employees who are already in Government Service and are covered by the NPS must also provide family details in Form 2 to the Head of Office along with Form 1 for record and submission to the Central Record Keeping Agency.

By the 11th of June, the DGHS had requested that all officials submit their ideas to the Head of Office through their appropriate Establishment Division.

• Family pension under CCS(Pension) Rules, 1972 as per Government servant’s option or a default choice, or if Government servant has selected for benefits via NPS, the family will receive benefits from his accrued pension wealth under NPS.
